At the end of your 24-month lease contract, you must return the phone to us. You can choose to:

  • upgrade your phone on a new eligible 24-month phone and service plan; or
  • make an offer to purchase your phone from us for its Fair Market Value, which we will advise at the time.
  • If you don’t return your phone at the expiry of your phone lease contract, you will continue to pay the monthly lease payments for your phone and plan (including any Mobile Swap Assure fees) on a month-by-month basis for up to 6 months until you return your phone. If it’s still not returned after 6 months, we will charge you a non-return fee of up to the Fair Market Value of your phone (to be advised at the time).
 

Important legal rights called Consumer Guarantees

For products you buy from us, you also have legal rights known as Consumer Guarantees. This includes a guarantee that those products will be fit for purpose, safe, durable, acceptable in appearance and free from faults for a reasonable period of time having regard to factors like the type of product and its cost. Consumer guarantees apply regardless of any manufacturer’s warranty or Telstra policies and can apply even after the manufacturer’s warranty has ended.

You’re entitled to a solution if a product doesn’t meet a consumer guarantee. Where a product is faulty, the solution will depend on the type of fault and whether that fault is ‘major’.
