YTT Terms
Your access to and use of Telstra's online services and Your Telstra Tools is governed by these Terms of Use ("TOU") (as updated or varied from time to time), the telstra.com Terms of Use and Telstra's Privacy Statement. You must use Telstra's online services and Your Telstra Tools in accordance with these terms and Telstra's Privacy Statement. In the event of any conflict or inconsistency between these TOU and the telstra.com Terms of Use, the relevant provision in these TOU will prevail to the extent of such conflict or inconsistency.
Please read these terms carefully to be sure that you understand them. You should be aware that we can change any terms and conditions of the TOU at any time. However, this online version of the TOU will always be updated to reflect those changes we make. Your continued use of Telstra's online services and Your Telstra Tools following such changes will represent an agreement by you to be bound by the terms and conditions of the TOU as amended.
- By registering with Telstra's online services, you obtain access to many of Telstra's online applications, including access to Your Telstra Tools.
- Your Telstra Tools is an online portal which is available as part of telstra.com to our selected customers.
- Telstra's online services and Your Telstra Tools is provided to you by us and no title in the website or applications passes to you.
- Telstra may also make available to you information on your services with us via Your Telstra Tools (or you may search for such information). This information may include planned network outage notifications, activation reports and other items. Such information will be provided at our discretion and, while we endeavour to ensure the correctness of such information, we cannot guarantee that it will be accurate at all times.
1. You agree that all information provided by you during the registration process is true, accurate, up to date and complete. You agree to promptly advise us of any changes to your information so that it is true, accurate, up to date and complete.
2. You must use a security credential ("Login Credentials") to access Telstra's online services and Your Telstra Tools, which may take the form of a username, Business ID and password, or a digital certificate or other security-related technology. We may require you to use different types of Login Credentials to access different parts of Telstra's online services and Your Telstra Tools. You may only use the The Login Credentials for the purposes of accessing Telstra's online services and Your Telstra Tools and for authorising instructions or requests using the Telstra's online services and Your Telstra Tools services made available from Telstra's online services and Your Telstra Tools. You must keep your Login Credentials and all security credentials to access Telstra's online services and Your Telstra Tools confidential and secure from unauthorised use. Please refer to section 6 of the telstra.com Terms of Use for additional obligations regarding the security of your Login Credentials.
3. You warrant that you are 18 years of age or older. You acknowledge that Children under the age of 18 may not use Telstra's online services and Your Telstra Tools.
4. If you are using Telstra's online services and Your Telstra Tools on behalf of another person, for example, your employer, or the person in whose name the Telstra account is registered ("Authorising Person") you must be authorised to:
1. use Telstra's online services and Your Telstra Tools; and
2. agree to the TOU, on behalf of the Authorised Representative.
5. You acknowledge and agree that you are responsible for:
1. keeping your Login Credentials confidential and secure at all times;
2. access to and use of Telstra's online services and Your Telstra Tools and applications within Your Telstra Tools by any of your employees or other Authorised users that you ask us to give access to.
6. We will not be responsible if you disclose your Login Credentials to any unauthorised persons or for the actions of any person you authorise to access Telstra's online services and Your Telstra Tools.
7. You acknowledge and agree that any of your employees or other authorised users that you ask us to give access to Your Telstra Tools and applications within Your Telstra Tools will be provided with full access and usage rights to these applications, unless you ask for such access and usage rights to be limited. We do not guarantee that we will be able to apply the limitations on access and usage rights that you require. If we are not able to apply the limitations you require, we will let you know.
8 If you make a photo available as part of your profile you acknowledge and agree that that photo may be viewed by you, your Administrative User (if applicable) and your Authorised Representative.
1. You must not:
1. use Telstra's online services and Your Telstra Tools for any activities, or post or transmit to or via Telstra's online services and Your Telstra Tools any information or materials, which breach any laws or regulations, infringe a third party's rights (including intellectual property rights) or privacy, or are contrary to any relevant standards or codes;
2. use Telstra's online services and Your Telstra Tools in a way, or post to or transmit to or via Telstra's online services and Your Telstra Tools any material, which interferes with other users or defames, harasses, threatens, menaces or offends any person or which inhibits any other user from using or enjoying Telstra's online services and Your Telstra Tools;
3. make any fraudulent or speculative enquiries, or requests using Telstra's online services and Your Telstra Tools;
4. use another's Login Credentials or name without permission;
5. provide false information when registering or changing your Your Telstra Tools registration details;
6. impersonate another person when using Your Telstra Tools;
7. post to or transmit to or via Telstra's online services and Your Telstra Tools any obscene, indecent, inflammatory, offensive or pornographic material or material that could give rise to civil or criminal proceedings;
8. tamper with, hinder the operation of or make unauthorised modifications to Telstra's online services and Your Telstra Tools;
9. knowingly transmit any virus or other disabling or limiting feature to or via Telstra's online services and Your Telstra Tools;
10. attempt any of the above acts or permit another person to do any of the above acts;
11. use the Login Credentials for any purposes other than those contemplated by clause
12. use or attempt to use the Login Credentials to (or disclose the Login Credentials for the purpose of enabling another person to) perform any tests, monitoring or assessment of Telstra's online services, Your Telstra Tools or those Login Credentials, whether relating to security, operation or performance or otherwise.
2. We may remove your page or data from your page at any time if we reasonably determine that you are in breach of these obligations. We will try to notify you before we do so.
- You may change the profile settings to customise Your Telstra Tools ("Your Profile"). We do not guarantee that Your Profile will be archived onto a backup mechanisms on a regular basis for the purposes of disaster recovery. In the event of a disaster (including equipment failure or data corruption), we will use reasonable endeavours to restore Your Profile (including links you put on your page) from any last known good archive.
- You grant to us all rights, consents, permissions and licenses necessary to enable us and our subcontractors and suppliers to legally view, copy and store Your Profile for the sole purpose of performing our obligations under these terms or any law.
- You agree to complete project scorecards, surveys or feedback forms that we ask you to complete from time to time (including when you decide to stop using Your Telstra Tools).
- You agree that we can use, reproduce, reformat, publish, modify, adapt and transmit to others free of charge and without restriction the information provided by you to us via Your Telstra Tools (for example on project scorecards, surveys or feedback forms), subject to our obligations in our Privacy Statement. Note, we can do these actions even after you have stopped using Telstra's online services and Your Telstra Tools.
- If you upload, transmit, post or otherwise make any documents or other information available on Your Telstra Tools, (including any documents or information made available by you as part of the Contract Collaboration tool) you must ensure that those documents or information are up to date; not misleading; not defamatory; do not contain offensive language or material; do not breach any laws, standards, content requirements or codes; do not infringe the rights of, or breach any duty to, any third party (including that third party's intellectual property rights); and do not and will not expose us to the risk of any claim, legal or administrative action or prosecution.
- If, in our reasonable opinion, any documents or information uploaded, transmitted, posted or otherwise made available by you (including any documents or information made available by you as part of the Contract Collaboration tool)breach clause 6.1 or are the subject of any claim, complaint, investigation, legal or administrative action or prosecution, we may in our sole discretion and without notice to you, remove that documents or information from Your Telstra Tools or cease making Your Telstra Tools available to you. We will not be liable to you if we remove that document or information.
- You warrant that you will conduct such tests and computer virus scanning as may be necessary to ensure that documents uploaded by you (including any documents or information made available by you as part of the Contract Collaboration tool) onto, or downloaded by you from, our systems do not contain any computer virus and will not in any way, corrupt the data or systems of any person.
- Any documents or information which you make available on our Contract Collaboration tool will be accessible to you via the Contract Collaboration tool until the contract status is finalised (Finalisation). After Finalisation these documents and information will not be available to you via the Contract Collaboration tool. You should ensure that you keep copies of all such information which you make available on the tool for your own records and do not rely on us or the Contract Collaboration tool to keep copies of any such information for any purposes.
- You agree that any documents or information which you make available on the Contract Collaboration tool we may use and make copies of for the purpose of working on our contract with you (including making it available to any third parties who assist us in any way with such contracts) and we may copy, store and disclose copies of the documents and information in accordance with our company policies and legal obligations.
- Applications and online serviceavailable on Telstra's online services and Your Telstra Tools are subject to the terms and conditions accompany the applications (if any). It is very important that you read and understand those additional terms and conditions. Some applications, such as Livechat may not be available at all times
- We will take reasonable steps to secure Telstra's online services and Your Telstra Tools and the systems in our control that are used to access Telstra's online services and Your Telstra Tools. However, due to the nature of the service, we cannot guarantee or warrant that Telstra's online services and Your Telstra Tools will be error or fault free, continuous or available at all times, that any defects will be corrected, or that the service or server will be free of viruses. Your access to Telstra's online services and Your Telstra Tools may be suspended without notice to you if we undertake systems maintenance or repair or for any other reason beyond our reasonable control.
- If you experience a problem with Your Telstra Tools, you should contact us on 1300 835 787. We will use reasonable efforts to rectify problems with Your Telstra Tools properly notified to us.
- Although we may from time to time monitor or review content including individual documents accessed from or stored on Your Telstra Tools, we are under no obligation to do so and assume no responsibility or liability arising from the content.
- Links from Your Telstra Tools may lead to third party websites that are not under our control. We are not responsible for the content, availability or functionality of any third party site and do not endorse any content available at third party sites.
- Third party products, services (including applications) and information offered or advertised via Your Telstra Tools are not provided or endorsed by us. Where it is apparent that products, services and information are not provided by us, your legal relationship in respect of those products, services and that information is with the third party supplier.
- We have not checked the accuracy or completeness of the information or the suitability or quality of the products and services (including applications) of the third parties. You must make your own enquiries with the relevant third party supplier (including whether additional charges and terms which apply).
- Some or all of the prices for products and services displayed on Your Telstra Tools are subject to Telstra's Our Customer Terms and may change from time to time. All prices displayed and products and services offered for supply on Your Telstra Tools are subject to change without notice. You should check the price of a product or service before placing an order for it.
- Telstra may use, collect and disclose information provided by you on Telstra's online services and Your Telstra Tools in accordance with the Telstra Privacy Statement.
- If your online role on Telstra's online services and Your Telstra Tools is that of an Authorised Representative or an Administrative user, your information, including your name, email and phone number provided by you, will be disclosed to the online users that you manage.
- We offer you the ability to access personal information or company information under the Terms of Use, on the strict condition that you only do so for the sole purpose of accessing your own personal or own company information.
- We offer you the ability to access Telstra staff's contact details under the Terms of Use, on the strict condition that you only do so for the sole purpose of contacting us for business-related queries associated with your account.
- To avoid doubt, by requesting via Telstra's online services and Your Telstra Tools that Telstra send information to a person's email address or phone number, you authorise Telstra to disclose to that person your personal or company information.
- You acknowledge that your personal information may be stored and processed in Australia, the United Kingdom, United States or any other country where we, or our suppliers, contractors and / or agents have facilities, and you consent to the transfer of information outside of your country.

In addition, you are liable for any loss , damage, liability, expenses or costs suffered by us or a third party arising out of documents or information that you load post, transmit onto or submit via Telstra's online services and Your Telstra Tools.
3. You indemnify us against any loss, damage, liability, expenses or costs incurred by us as a result of:
1. your use of Telstra's online services and Your Telstra Tools; the use of Telstra's online services and Your Telstra Tools by your employees and other authorised users or third parties that you ask us to give access to Your Telstra Tools; and
2. a claim by a third party against us that any documents or information provided by you to us via Telstra's online services and Your Telstra Tools infringes the intellectual property of that a third party.1. Our liability to you is set out in the telstra.com Terms of Use.

1. your use of Telstra's online services and Your Telstra Tools; the use of Telstra's online services and Your Telstra Tools by your employees and other authorised users or third parties that you ask us to give access to Your Telstra Tools; and
2. a claim by a third party against us that any documents or information provided by you to us via Telstra's online services and Your Telstra Tools infringes the intellectual property of that a third party.
1. You may stop using Telstra's online services and Your Telstra Tools at any time, for any reason.
2. We may discontinue or change Telstra's online services and Your Telstra Tools, or a part of Telstra's online services and Your Telstra Tools, at any time and without notice to you.
3. Without limiting any other provision of the TOU, we may immediately suspend, terminate or limit your access to Telstra's online services and Your Telstra Tools if:
1. you are in breach of the TOU;
2. there is an emergency;
3. we are required by law.
- Unless otherwise stated, all communications about Your Telstra Tools will be sent to the email address or mobile phone number (via SMS) nominated by you at registration. You must ensure that your contact details on Your Telstra Tools are current, your email service or mobile phone account is operational and that you check your emails or mobile phone regularly for messages.
- The TOU are governed by the law in force in the State of New South Wales, Australia, and the parties irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia and courts of appeal from them for determining any dispute concerning this agreement.
- If we do not act in relation to a breach by you of the TOU, this does not waive our right to act with respect to subsequent or similar breaches.
- You may not assign or transfer your rights or benefits under the TOU to any other person or entity without our prior consent, which we will not unreasonably withhold.
