Overview
We’re delighted to have you involved in the Telstra Plus Marketplace trial (Trial). We have developed a prototype product to test out a range of concepts, features and functions with a select group of customers. Certain features of the prototype may be illustrative or shown as examples only.
To be involved in the Trial, you must agree to the terms and conditions, and meet the eligibility criteria, as set out below. Our Privacy Statement will also apply to your involvement in the Trial. Our Telstra Plus terms and conditions will continue to apply to you as a Telstra Plus member, and to any points bestowed as part of this Trial. Joining Marketplace
Joining the Trial requires you to have met the following conditions:
- You are over 18
- You are a member of Telstra Plus
- You have received an invitation from Telstra to participate in this Trial
Trial Duration
The trial will commence from the beginning of September 2021 and will conclude end of October 2021 unless otherwise extended (Trial Period). We will let you know exact start and end dates as soon as they are known. At the end of the Trial Period you will be removed from the Trial, and will no longer have access to the Telstra Plus Marketplace app. We may shorten or extend the Trial Period by providing you with as much notice as possible.
What does the Trial involve?
This Trial is designed for you to test out our Prototype Telstra Plus Marketplace app (Marketplace app), which is designed to connect our Telstra Plus members, with our small businesses. The Marketplace app will contain offers for services and products from our small businesses participating in the Trial, with Telstra Plus points allocated to each offer (Offer), which will be awarded to you once you have paid for the product or service from the small business. Payment is made directly to the business in all circumstances. The Trial will involve you:
- Signing up to the Trial via the Marketplace app;
- Entering the required personal information (noting that some of it is optional)
- If you choose, engaging the services of/purchasing products advertised on the Marketplace app by the small businesses participating in the Trial. This is completely optional.
You will be allocated a unique six digit code to access the Marketplace app. You must not disclose this code to anyone, and you are solely responsible for keeping it confidential. If we discover that you have shared your code with anyone else, we reserve the right to remove you from the Trial immediately and without notice.
Your Data – Collection, Storage and Use
As part to the Trial, we will ask you for certain personal information, including (but not limited to) your first name, email address, the suburb you live in, your interests and your data sharing preferences. Some of the information we will ask for, you may have already provided to us previously when taking up Telstra services. The reason why we will be asking you for these details again is because the Marketplace app is built by a third party called Transpire, so your personal information has not been shared between Telstra and this app.
If you consent to their use, we may use your interest categories and your residential location to show you recommended Offers. As part of the Trial, we will allow you to explore setting different types of preferences for your personal data (i.e. such as your Device Location). These additional preferences are illustrative only and do not live in the prototype, which we will inform you of within the Marketplace app.
Your information is stored securely on servers within Australia. Your information will not be sold to any third parties, and will not be shared with any third parties other than those mentioned in these terms, and is only shared with those third parties in order to assist us to administer the Trial. Any additional information provided as part of the Trial will be deleted at the end of the Trial or at any stage you ask us to.
Card Linking, Offers and Bonus Points
To take advantage of an Offer posted in the Trial, you need to link your credit card or Debit/EFTPOS card (payment card) in the Marketplace app. When you make a qualifying purchase with that linked payment card (either in store or online), we will know to award you your Telstra Plus points.
By linking your payment card, you authorise Telstra to share your payment card information with Mastercard, Visa, and EFTPOS Australia (as applicable) so they:
- know you have enrolled in the Trial; and
- can monitor transactions on your registered payment card(s) to identify qualifying purchases for Offers you have redeemed, that will earn you Telstra Plus points (eligible transactions).
By linking your payment card in the Marketplace app, you also authorise Mastercard, Visa and EFTPOS Australia (as applicable) to share these eligible transaction details with Telstra to enable us to award you with the Telstra Plus points allocated to the Offers you have redeemed. You may remove your linked payment card (or cards) in the Marketplace app (via the Profile section) at any time. You can browse Marketplace without any linked payment cards, however, to be eligible to earn Points via an Offer in Marketplace, you need to have linked and purchased with your payment card.
All payments are made directly to the business you have acquired the product/service from. You are only providing your payment card details to us to enable us to identify your transaction and award you the Telstra Plus points connected with your Offer. You do not have to enable an Offer in the Marketplace app, if you transact with the business who posted the Offer and meet the required eligibility for the Offer, you will earn the advertised Telstra Plus points. The points will be triggered once a successful payment has been completed via the linked payment card. Points will appear on your account within 14 days of payment being made.
Please note: for the trial, not all transactions will be eligible for points, these include, but are not limited to, transactions made using; AfterPay, PayPal, Zippay, cash, cheque, AMEX, Diners Club, all buy now pay later platforms (e.g. Afterpay) and direct deposit.
Telstra Plus Marketplace Bonus Points offer available until the end of the trial. If you sign up to Marketplace app and make eligible purchases from participating businesses after this date, you will not be eligible for the bonus points.
20,000 bonus points: Will be loaded onto your Telstra Plus account within 14 business days of downloading and signing up to the Marketplace app with your unique code.
30,000 bonus points: Will be loaded onto your account within 14 business days of making payment for your first eligible purchase of a product/service advertised on the Marketplace app by a participating business.
Provision of Products and Services
You as a customer agree and acknowledge that:
- Telstra’s role in this Trial is to operate the Marketplace app, and to load the Telstra Plus points on your account that the business has allocated to an Offer, once you have taken up and paid for an eligible Offer.
- The business who has advertised products and/or services via the Marketplace app is responsible for the fulfillment of the product/service in a manner reasonably expected. Telstra is not responsible for quality, fulfilment or delivery timeframes connected with the product/service you have acquired, and makes no representation or warranty, and accepts no liability whatsoever in respect of the products/services (except to the extent that cannot be excluded under any consumer law or other law, which shall remain in full force and effect).
- We do not warrant the quality or competency of any business advertising on the Marketplace app, nor do we warrant that any information they provide in their Offer is true and correct. We rely on the businesses listed on the Marketplace app to provide accurate information, and we assume no responsibility for verifying that information.
If you have a dispute regarding a product or service you have acquired from a business on the Marketplace app, you need to resolve this with the business who provided it . In the event that you cannot resolve the dispute with the business, please let us know, because even through we can’t resolve the dispute for you, it is important that as part of the Trial we stay across any issues that arise between businesses and consumers participating in the Trial. We’d love to hear your feedback so we can continue to add new features and improvements. We might ask for your feedback via a survey, invite you to a focus group or ask for feedback on our Forum, all of which is optional as part of your participation in the Trial. Please remember this is a closed Trial
We hope that you’re as excited about the Trial as we are. By being involved in the Trial, you may become aware of or get access to things before the rest of our customers and the general public. This is a closed Trial, so we are happy for you to discuss offers with businesses as part of the Trial, but we ask that you don’t share your invitation with anyone else or discuss the Trial with friends, colleagues and/or the media.
Expect the unexpected
As this is a pre-release “beta” version of the Marketplace App, some features may not yet work as they are intended to. The service might change or features might be removed without notice. While we will use reasonable care and work with you to resolve any problems, we can't guarantee that the experience you receive as part of the Trial will always be free from faults. To the extent permitted by law, we exclude all liability arising from or in connection with the Marketplace App. The Marketplace app may change or features may be removed without notice.
Exiting the Trial
If you no longer want to be involved in the Trial, that's okay with us. We'll miss you, but you don’t have to stick around if you don’t want to. We will be happy to remove you and delete any additional data of yours collected as part of the Trial if you contact us at TelstraPlusBetaTeam@team.telstra.com
We may cancel, suspend or interrupt the Trial at any time with immediate effect, but we will try and give you as much notice as we reasonably can.
If you do something which is contrary to these terms and conditions, that breaches any other laws or that we determine is either abusive, fraudulent or not in the spirit of the Trial, or you become ineligible to participate, then we may suspend or end your involvement in Trial.
Consumer Guarantees
If the Competition and Consumer Act 2010 (Cth) or any other legislation states that there is a guarantee in relation to our supply of the Marketplace app supplied by us in connection with this document, and our liability for failing to comply with that guarantee cannot be excluded but may be limited, then our exclusion of liability described above does not apply and instead our liability for such failure is limited to (at our election) us supplying the services again or paying the cost of having the services supplied again.
Finally
All intellectual property rights related to the Trial and the Marketplace app, belong to us or our licensors. Even if you don’t live in Victoria, these terms and conditions are governed by the laws of the State of Victoria, Australia.
